XboxLiveParty BNT Banned Xbox 360 Users, Class Action Lawsuit

Recently Microsoft has begun taking action against users of the games system that have chosen to modify their consoles.  Microsoft has denied many of the banee’s a reason for the update that corrupts their gamer profile, and removes some functionality of their hard drive units.  It was recently announced that A potential class action lawsuit against Microsoft following the bannings has surfaced, encouraging users to take part.

A small firm by the name of Abington IP has posted a form on their site for disgruntled users that were banned from the Xbox Live service.  And in its current form, Abington is looking for refunding of monies in regards to Xbox Live Subscriptions that are fairly useless without an Xbox that can connect to the service.

“As has been reported widely in the media, tens of thousands of Xbox owners have had their modified Xbox consoles banned from Microsoft’s online gaming service Xbox Live. Although modification of Xbox consoles is against the terms of use for Xbox/Xbox Live, Microsoft “conveniently” timed the Xbox console ban to occur just after the release of the new Call of Duty: Modern Warfare 2 game and less than two months after the release of the very popular Halo 3: ODST game. This “convenient” timing may have resulted in more Xbox Live subscription revenues for Microsoft than it would have generated had these Xbox console bans taken place at some time before the release of Call of Duty: Modern Warfare 2 and Halo 3: ODST. Additionally, sales of both Call of Duty: Modern Warfare 2 (published by Activision) and Halo 3: ODST (published by Microsoft Game Studios) would likely have been greatly diminished had the Xbox console ban occurred prior to the release of these games.”

But, does this lawsuit open the door for other wrongful banning suits to follow?  If you check over at the forums at Xbox.com it is littered with hundreds of stories of being wrongfully banned.  If you bought a used console in the past year there is a chance that you are next.  But then who is blame laid on then…Gamestop?

    That’s why i like computers. I can mod the shat out of it and not get banned, But if they were hax they deserved it,
