
“Microsoft Corp. has responded to a possible class-action lawsuit over banning up to one million Xbox 360 consoles from accessing its online gaming service, arguing the company is well within its rights to ban users from Xbox Live.
A spokesperson from Microsoft reacted to the possible lawsuit on Friday. “Piracy is illegal and modifying an Xbox 360 is a violation of the Xbox Live Terms of Use. Microsoft is well within its legal rights to ban these users from Xbox Live.”
I’m pretty sure they planned on saying “go F$#^ Yourselves, and then the legal team said “maybe you should try this”. It all works just the same.

Won’t lie I’m no angel but if I got busted I for copying games(which I don’t by the way) I sure as hell won’t be crying about it saying MS sucks or sueing them for doing what is within their rights. Personally I am very happy that Microsoft timed it just after the release of MW2 and just before the Holiday Shopping Season! It was an awesome move that sent a message to all those who were planning on getting their 360 modded after they got it for Christmas. There’s nothing wrong with pirating from pure evil… Hopefully pirates will keep it up and find new ways to mod the 360 so that M$ will need to be even more intrusive to its customer base to fight them. Not that it will do any good I suppose… I mean, you idiots already buy a console that breaks half the time and you keep coming back for more. i dont have a modded console and i havent been banned… it just grinds my gears when i see people throw the whole “ohh its illegal, pirates are the devil and the thorn in gamings shoe..bla bla” because you just KNOW that the chances are so absolutely minimal that these same ppl saying these things have NEVER pirated a thing in their lives. If you get banned well yeah tough s**t u knew the risks, but having people being all self righteous in regards to pirating is really just annoying. Everyone pirates content in some form or another.. even recording songs off radio or shows off tv is technically illegal

Chris, just recording sound and television shows is not illegal, it depends on what you do what the recordings. Pirating video games is morally wrong for people who understand that it gives people the option to not pay for a game but still play it and enjoy the content that was made with hard work. Morally, pirates should consider what it is like to software developers. The sales for the game may hit a just under a million, but two and half million may have played it. Sure, people may have shared the original disc, but many people would have bought the game if there was no other way of playing it. However, some people pirate under less harmful circumstances, despite it being illegal: the only circumstances I can think of are when you pay for a game in your country (money may not reach the same publishers but the same developers), and you pirate a different language version. And the reason why people are all so “self-rightous” towards pirates is because when pirates hurt the video game industry, they hurt those people too.

I would never purchase the burnt games I played. It’s really not “lost income” because I’m telling you they would have never seen a dime from me.

Let’s be real here. Anyone who mods their console and gets caught, and then proceeds to sue Microsoft because they got caught and banned are utterly pathetic. At least all you have is a banned console. Your IP could in theory be turned over by Microsoft to the authorities who could then do a search to see if you have illegally downloaded software or games. Then you would be in much more trouble than just a banned console. Complaining about idiots who pirate music is idiotic. Stupid single mothers sitting at home downloading mp3’s don’t get their computers banned, they get made an example of by the RIAA and get sued for millions of dollars. You should only be so lucky with JUST a banned console. And yes, you may own the console and the games that you actually bought, but you don’t own the software that you are connecting to. So if you have a pirated game and a modded console, why should they let you connect to their network? They own it. And I don’t want to hear any modders say that they would be perfectly fine with just getting banned from Xbox Live as long as they still had their console. Because without a gamertag, you still are SOL, who will only play the game on their own and not online?

you sing a contract with M$ agreeing to their terms and conditions when you bought your 360 and paid for live.

ok, Ive read all these comments and i agree for the most part. But heres what I think is stupid. Ok, you get you 360 modded, you know that youll get banned if caught, but your stupid enough to play online with it? Thats the stupid part. If you were smart you would NEVER even hook the modded one up to the internet. If I did this, I would do it this way. The 360 I already have would stay the same. Then get a cheap arcade one with built in memory and use that for single player “back-ups” And your other one for online. If you dont have the cash for another one, then just know that if you mod your only 360 your losing all online play.

First: You should not get banned playing a modded console UNLESS you are connected to the internet AND have a burnt game in. Second: I only cant stand people glitching and cheating in games. Rapid fire controllers, things of that nature. Third: Ban everyone who violates! The less riff raff the better!
